The Legal Implications of Breastfeeding Are Centred Around Four Individuals Sheikh Uthaymeen raαΈ₯imahullāh states: Firstly, we need to know that the effects of breastfeeding (in terms of legal and familial rulings) pertain specifically to four individuals: (1) the nursing woman (wet nurse), (2) her husband, (3) the nursed child, and (4) the descendants of the nursed child. As for other relatives beyond these four, they are not affected by the rulings of breastfeeding! ... For example: If a baby girl is breastfed by a woman named Zaynab, whose husband is named ’Ali, then the child who was nursed by Zaynab would consider Zaynab as her mother through nursing, and ’Ali as her father through nursing. Now, what is the status of ’Ali’s children with respect to this nursed child? They are her siblings. And Zaynab’s children? They too are considered siblings. What about ’Ali’s children from another wife (not Zaynab)? They are siblings as well, but paternal siblings through nursing. And Zaynab’s children from another husband? They are also siblings, but maternal siblings through nursing. As for the descendants of the nursed child β€” that is, his or her sons, daughters, grandsons, and granddaughters β€” they all fall under the legal effects of nursing. Accordingly, the nursing woman becomes a grandmother to the descendants of the nursed child, and her husband becomes a grandfather. These descendants are thus treated, in relation to the nursing woman and her husband, as maternal or paternal grandchildren. If you have understandood think, know that the siblings of the nursed child are not affected by the rulings of nursing β€” pay close attention to this point! Likewise, the uncles of the nursed child are also unaffected by nursing. ... Based on this, if a person was breastfed by a woman named Zaynab (as in the example), and Zaynab has daughters, then those daughters are forbidden in marriage to the nursed child. However, the siblings of the nursed child β€” his brothers β€” are not prohibited from marrying Zaynab’s daughters. That is because the rulings of breastfeeding do not extend to the siblings of the nursed child. Therefore, it is permissible for the brother of the nursed child to marry the daughter of Zaynab, who breastfed his brother.
