Conducting two Nikāhs Question: We held a small Nikāḥ ceremony and all the conditions were met, however some of the relatives requested to repeat the Nikāḥ once again to allow more relatives to witness the occasion. What is the ruling on repeating the marriage contract in this case? ▪️Sheikh Muḥammad Al-’Ansi ḥafidhahullāh (https://t.me/madrasatuna/3140): “As you have mentioned, if the contract has fulfilled the pillars and conditions, it is a valid contract. I mean, if the guardian is present; i.e. the woman’s guardian, the husband, and two witnesses, and the girl's father says to whomever he wants to marry her off to, “I marry you my daughter, so-and-so,” and he mentions her name, and the other party says, “I accept,” the marriage is complete. There remains the issue of announcing the marriage. This is something that people have become accustomed to. It is a symbol of marriage so that it does not resemble incestuous marriage. The Prophet ﷺ said: ((أعلنوا النكاح واضربوا عليه بالدف)) “Announce the marriage and beat the duff (drum) for it.” As for repeating the contract on this basis, there is no point; because it is a valid contract. But as a consolatory gesture, there is nothing wrong if, for example...because this is considered a mistake on their part (i.e. For not inviting those relatives who should have been invited, etc.)..there's no harm if they invite whoever they could from their relatives, acquaintances, brothers, etc., to a banquet, and people know that this is a marriage and they announce it; because this is allowed; in order to remove any ill feelings, so they prepare a feast for themselves and they manifest some permissible joy and pleasure. As for repeating the marriage contract, there is no reason for it, and Allāh knows best.” ▪️Sheikh ’Abdulkhāliq Al-’Imād ḥafidhahullāh (https://t.me/madrasatuna/3138): “It is possible to repeat the walīmah (banquet) without repeating the marriage contract. It is not necessary to repeat the contract as long as the contract has been concluded and it is a valid contract and it is known that so-and-so is married to so-and-so and witnesses were present. The contract is valid, so repeating it is meaningless...” ▪️Sheikh Muḥammad Bā-Jammāl ḥafidhahullāh (https://t.me/madrasatuna/3139): “The Nikāḥ is valid and the contract is valid, and it is not necessary to host a large banquet. The Prophet ﷺ held a walīmah banquet for Ṣafiyyah with only 80 guests. It is not necessary to invite a lot of people for the Nikāḥ, nor it is necessary to host a big banquet. Rather, the Prophet ﷺ told Abdurrahmaan: ((أولم ولو بشاة)) “Host a walīmah banquet, even with just one sheep.” So they not need to repeat the Nikāḥ, because the (first) Nikāḥ is valid. But if he wants to invite his in-laws, because they missed out the first time around, that's fine he can invite them. But it's not necessary to do another wedding (i.e. Nikāḥ).” ___ T.N. Here are three reasons why it may be advisable to repeat the Nikāḥ: ▪️1st REASON: If the officials request it: https://t.me/madrasatuna/3141 ▪️2nd REASON: If there is some element of doubt: https://t.me/madrasatuna/3142 NOTE: Other scholars allowed this method provided they are sure it's them on the other side of the line! ▪️3rd REASON: To ward off any harm: https://t.me/madrasatuna/3146 CLOSING ADVICE: If someone anticipates a family uprisal for hosting a small Nikāḥ, and he expects them to demand a repeat of the Nikāḥ in the presence of the bigger audience at the walīmah banquet, then it's advisable to just host one ceremony catering for all - if this is possible. Our religion has legislated only one marriage contract, and this was the practice of the Muslims throughout the centuries...but now it has become common practice in certain cultures to perform a small Nikāḥ to secure the marriage, then thereafter to host a big walīmah and repeat the Nikāḥ for all to witness; the first being the legal Nikāḥ and the second being a consolatory show to please the people. ➡️@womensbenefits
