Ruling on a Widow Performing Hajj During Her Waiting Period (β€˜Iddah) Question: The questioner states: A woman residing in America registered to perform the obligatory Hajj this year. She paid the required amount in U.S. dollars and secured a booking. However, it was decreed by Allāh that her husband passed away, and she is now in her waiting period (β€˜iddah). She is unable to recover the money she paid. Is it permissible for her to perform Hajj while in her β€˜iddah so that the money is not lost, or what should she do? Sheikh Yahya hafidahullah: This issue was addressed in a fatwa published recently, based on the hadith of Al-Furayβ€˜ah. The ruling is that she must remain in her home β€œuntil the prescribed term is fulfilled” [2:234]. This is also the fatwa among some of the scholars. It is reported that ΚΏUmar ibn Al-Khattab (may Allāh be pleased with him) turned back women during their waiting period. Therefore, she must not travel while she is in β€˜iddah, including for Hajjβ€”even if the payment has already been made. It is upon the Hajj agency to return her money, for Allāh says: β€œDo not consume one another’s wealth unjustly” [2:188]. What gives them the right to withhold her funds?!
