The Permissibility of Divorcing a Pregnant Woman Sheikh Mushtāq Adh-Dhali'ee hafidahullah: Divorcing a pregnant woman is permissible and unobjectionable, as it falls under the category of Ψ·Ω„Ψ§Ω‚ Ψ§Ω„Ψ³Ω†ΩŠ (legitimate form of divorce), not Ψ·Ω„Ψ§Ω‚ Ψ§Ω„Ψ¨Ψ―ΨΉΩŠ (innovative or illegitimate form). Thus, it is allowed to divorce a pregnant woman just as it is allowed to divorce other women. What is prohibited is divorcing a woman during her menstruation, or divorcing a woman in a period of purity in which the husband has had sexual intercourse with herβ€”such cases constitute Ψ·Ω„Ψ§Ω‚ بدعي. As for divorcing a pregnant woman, there is no prohibition or issue associated with it, and pregnancy has no bearing on the permissibility of divorce. And Allāh knows best.
