Khul’ Is Not Subject to Time Restrictions Unlike Divorce This is supported by the general permissibility indicated in Allāh's words: ﴿فَلَا جُنَاحَ عَلَیۡهِمَا فِیمَا ٱفۡتَدَتۡ بِهِ﴾ "There is no blame if the wife compensates the husband to obtain separation." [Surah Al-Baqarah: 229] This view is held by the majority of scholars, though Mālik held a differing opinion. Al-Baghawi, may Allāh have mercy on him, said in 'Ma’ālim At-Tanzeel' (8/148): «والخلع في حال الحيض، أو في طهر جامعها فيه: لا يكون بدعياً؛ لأن النبي ﷺ أذن لثابت بن قيس في مخالعة زوجته من غير أن يعرف حالها، ولولا جوازه في جميع الأحوال لأشبه أن يتعرف الحال» "A khul’ during menstruation or in a period of purity in which intercourse occurred is not considered a bid'ah (innovative or invalid for of separation). This is because the Prophet ﷺ allowed Thābit ibn Qays to separate from his wife through khul’ without inquiring about her state. Had it not been permissible in all circumstances, he would likely have sought clarification of her state." @womensbenefits
