She Wants to Leave Her Husband Due to His Mistreatment and Lack of Trust
Question: A woman is seeking your advice. She says that her husband is suspicious and does not trust her. He has prevented her from visiting her uncles' house and makes things difficult when staying at home. He only prays in the masjid on Fridays, physically abuses his mother and sisters, and shows no respect for her family. She is now at her father's house and wants a divorce. What advice can you give her?
Sheikh RashΔd Adh-Dhali'ee αΈ₯afidhahullΔh:
Marriage is established for great purposes, including the fulfillment of AllΔh's rights, cooperation in righteousness and piety, and obedience. If a marriage becomes a source of disobedience due to harm and mistreatment, and if she cannot endure her husbandβs behaviour while he cannot endure her, leading to her being confined and mistreated, she may seek divorce. In this case, there is no sin in her requesting divorce. The default is that seeking a divorce is not permissible for a woman unless there is a valid reason. The Prophet ο·Ί said, "Any woman who asks her husband for a divorce without any justification, Paradise is forbidden for her." However, if there are legitimate reasons, such as those she mentionedβfeeling restricted, being subjected to suspicion and doubt, and being prevented from maintaining family tiesβthen if it reaches a level of harm and oppression, and if rights are compromised and disobedience to AllΔh occurs, she is entitled to request a divorce without being sinful. That is after she has been patient, prayed for her husbandβs guidance and reform, and exerted effort to mend the relationship, if she finds that it is of no benefit, then she may seek a divorce without issue. The devil is eager to create discord between spouses through mistreatment, restrictions, or by planting doubts and suspicions. What kind of life is it for someone who remains suspicious of their spouse? What kind of life is it for a wife to live with a husband who does not trust her?
