She gave birth 4 months into the marriage Question: What is the ruling in the case of a man who married a woman who had never previously been married and then she gave birth after four months. Should he remain with her? Sheikh Abdulhameed Az-Zu'kari αΈ₯afidhahullāh: This child is not his because the minimum gestation period is six months, as understood by the Companions of the Prophet (may Allah be pleased with them) in the case of a woman who delivered at six months. As for a birth after only four months, this could only result from another circumstance, and thus the child, in my view, should not be attributed to him. And Allah knows best. As for the woman, her situation should be assessed. If she has repented sincerely, improved her conduct, and is now of good character, then the matter is left to him.
