Sheikh 'Uthaymeen, may Allah have mercy on him, responds: The recommendation to perform the marriage contract in the masjid has no basis or evidence from the Prophet ﷺ. However, if it so happens that the groom and the guardian are present in the masjid and the contract is performed there, then there is no problem with this (i.e. Mubāḥ). This is because it does not fall under the same category as buying and selling, which is generally prohibited in the masjid. Since the marriage contract is not a commercial transaction, performing it in the masjid is permissible. However, to consider it recommended such that people are advised to leave their homes and go to the masjid, or to arrange to meet in the masjid specifically for the marriage contract, this requires evidence, and I am not aware of any such evidence. Questioner: May Allāh bless you. Some people compare this to Christians who perform marriage contracts in churches. Sheikh 'Uthaymeen: This has never crossed our minds at all. Those scholars of the Shari'ah who see it to be recommended have no evidence for it. They simply argued that since the most beloved places to Allah are the masjids, and since this is the house of Allah, the marriage contract should ideally be performed there. However, this reasoning does not hold if there is no specific evidence for it; whereby the Prophet (ﷺ) would go to the masjid specifically to perform marriage contracts.
