Khulʿ: Start of the Waiting Period and Its Duration Question: A sister says: "I sought a khulʿ (Islamic divorce initiated by the wife). We went to court, and the judge held two reconciliation sessions between us. From the very beginning, I had already decided to proceed with the khulʿ. The case remained in court for some time until the judge finally issued the ruling. My question is: When does my waiting period (ʿiddah) begin? Does it start from the day I requested the khulʿ, or from the day the court officially issued the khulʿ ruling? Also, is the waiting period one menstrual cycle or three menstrual cycles? And what is the ruling if a woman does not follow the rules of the ʿiddah, such as going out without necessity, or if she believes that a woman who gets a khulʿ does not have to observe any ʿiddah at all? May Allah reward you with goodness." Shaykh Abduh Hussein Al-Yafi'i (may Allah preserve him): As for when the khulʿ waiting period begins: since the matter was taken to a judge, the waiting period starts from the date the judge issues the ruling. As for how long the ʿiddah is, there are two scholarly opinions. Sheikh Ibn Baz (may Allah have mercy on him) said: "The stronger opinion is that one menstrual cycle is sufficient. This is based on the hadith of Ar-Rubayyiʿ bint Muʿawwidh. When she obtained a khulʿ from her husband, the Prophet ﷺ instructed her to observe one menstrual cycle as her waiting period. A similar narration is also reported regarding the case of Thabit ibn Qays. In summary, if a woman separates from her husband through khulʿ in exchange for monetary compensation, then observing three menstrual cycles is better and more cautious, as it avoids the difference of opinion among the scholars. However, if she observes one menstrual cycle, that is sufficient, according to the stronger opinion of the scholars, based on the authentic Sunnah mentioned above. And Allah is the One who grants success." As for not observing the rulings of the ʿiddah, then she is sinning and going against the law of Allah that He has prescribed for her.
