Is a Divorce Valid If the Wife Is Not Told? Question: A man has been away from his wife for a long time, and he divorced her privately (only in his own mind/without telling her). Does the divorce take effect? Sheikh Uthaymin rahimahullah: The divorce takes effect even if the wife is not informed. If a person verbally pronounces the divorce and says, ‘I have divorced my wife,’ then the wife is divorced whether she knows about it or does not know about it. Therefore, if we assume that this wife did not learn about the divorce until after she had experienced three menstrual cycles, then her waiting period (`iddah) would already have ended, even though she did not know about the divorce. Likewise, if a man died and his wife only learned of his death after the waiting period had already passed, then she would not have a waiting period at that time, because her waiting period would have ended with the passing of the required time.
