Does a Divorced Womanβs Waiting Period End If She Aborts the Pregnancy?
Question:
A pregnant woman was divorced by her husband, then she miscarried her fetus. Does her waiting period (iddah) end because of the miscarriage?
Sheikh Yahya Al-Hajoori hafidhahullah:
Some scholars believe that once the fetus comes out β whether through birth or miscarriage β after the pregnancy has been confirmed, the womanβs waiting period ends. They say this is included in the saying of Allah:
βAnd for pregnant women, their waiting period is until they deliver their pregnancy.β
This is the stronger and more correct opinion. It applies whether the pregnancy ended naturally at full term, through miscarriage without a reason, or even if the miscarriage happened because of something the woman herself did intentionally or unintentionally. In all these cases, her iddah ends once the pregnancy has ended.
Ibn Kathir (may Allah have mercy on him) said: βWhoever is pregnant, her waiting period ends when she delivers the baby, even if it is only a very short time after divorce or the husbandβs death. This is the opinion of the majority of early and later scholars, as clearly stated in this Ayah and supported by the Prophetic Sunnah.β
He then mentioned hadiths supporting this view. Scholars also mention that miscarriage is included in the meaning of this Ayah.
So, this is the opinion we see to be correct: that a womanβs waiting period ends when the fetus comes out, whether through full delivery or miscarriage, whether it happened intentionally or unintentionally.
