"She Does Not Refuse the Hand of One Who Touches Her"
Narrated from Ibn βAbbas:
A man came to the Messenger of Allah (peace and blessings be upon him) and said: βI have a wife who is one of the most beloved people to me, but she does not refuse the hand of someone who touches her.β The Prophet said: βDivorce her.β The man said: βI cannot bear to leave her.β He said: βThen enjoy her.β

βͺοΈThe scholars differed about the authenticity of this hadith. Some considered it authentic, some considered it weak, and some rejected it.
Among those who considered it authentic were:
1. Ibn Hazm (in Al-Muhalla)
2. An-Nawawi (in At-Talkhis)
3. Ibn Hajar (in At-Talkhis)
4. Al-Albani (in Sahih Abi Dawood)
βͺοΈAssuming the hadith is authentic, the scholars also differed about the meaning. However, they agreed that it does not mean she was committing zina (adultery).
Imam Ahmad said: βThe Prophet (peace be upon him) would not have ordered him to keep her if she were committing adultery.β [Nayl Al-Awtar 6/172]
Explanation of the Meaning
Shaykh Al-Islam Ibn Taymiyyah explained:
Some people said that βthe one who touches herβ means someone asking her for money, but this explanation is weak. Rather, βtouchingβ may literally mean touching her with the hand, even without intercourse. Some women display their beauty openly (lack modesty), and if a man looks at them or puts his hand on them, they do not strongly push him away β but they do not allow intercourse. Marrying such a woman is disliked (makruh). That is why the Prophet told him to separate from her, but he did not make it obligatory β especially since the man said he loved her. So she was not committing adultery, but she was sinful in some lesser actions leading toward it. The wording mentions only touching by hand. When Arabic uses βtouchingβ to mean intercourse, it is not restricted to the hand. When it specifically mentions the hand, it means literal touching. [Majmuβ al-Fatawa 32/116]
Imam As-Sanβani said:
Saying that the hadith means immorality (adultery) is very far-fetched and incorrect. Allah says: βSuch a thing is forbidden for the believersβ (24:3). And the Prophet (peace be upon him) would never command a man to remain with a woman who commits adultery. The closer meaning is that she was soft in manners and not firm or modest with non-related men. This does not mean she committed fornication. Many men and women may behave in this careless way while still staying far from actual immorality. If the man had meant that she does not prevent men from having intercourse with her, then he would have been accusing her of adultery directly. [Subul As-Salam 2/284, summarised]
