Touching one's private part and its effect on wuḍū
Question: Does touching the private part of a child invalidate wuḍūʾ? And what is the authenticity of the ḥadīth of Busrah bint Ṣafwān, in some wordings of which it is reported that she heard the Messenger of Allāh ﷺ “commanding wuḍū due to touching the private part”?
Sheikh Rashād Adh-Dhali'ee ḥafidhahullāh:
This issue is based upon two prophetic traditions, which form the foundation of this discussion:
The first is the ḥadīth of Ṭalq ibn ʿAlī (may Allāh be pleased with him), recorded in the Sunan. He said: A man said, “I touched my penis,” or he said, “A man touches his penis during prayer—must he perform wuḍū?” The Prophet ﷺ replied: “No; it is only a part of your body.”
The second is the ḥadīth of Busrah bint Ṣafwān (may Allah be pleased with her), also reported by the compilers of the Sunan, in which the Messenger of Allah ﷺ said: “Whoever touches his penis should perform wuḍū.” And in some of its wordings—as mentioned by the questioner—she said that she heard the Messenger of Allāh ﷺ “commanding wuḍū due to touching the private part.”
Some scholars considered one of these two ḥadīths to be weak and acted upon the other, while others claimed that the ḥadīth of Ṭalq ibn ʿAlī was abrogated and that it dated back to the early period of Islam. The best interpretation given regarding this matter is that the command to perform ablution in the ḥadīth of Busrah (may Allah be pleased with her) indicates recommendation rather than obligation, while the ḥadīth of Ṭalq ibn ʿAlī shows that wuḍū is not obligatory due to touching the private part.
Likewise, the scholars extended this ruling to touching the private parts of another person, such as a woman touching the private part of a child. Based on this, if a woman touches the private part of a child, her wuḍū is not invalidated; however, it is preferable for her to perform wuḍū. And Allāh knows best.
