Does a Woman’s Wuḍū Become Invalid if While Washing Her Child She Touches Their Private Parts?
Scholars differ, may Allāh have mercy on them, regarding whether wuḍū is invalidated by touching the private parts of a child.
1⃣. First Opinion: wuḍū is invalidated by touching the private parts of a child, just as it is by touching those of an adult.
Ibn Qudāmah raḥimahullāh said: “According to the narration that wuḍū is broken by touching the private parts, there is no difference between a male or female, nor between a child or adult.” [Al-Mughni 1/118, paraphrased]
The Permanent Committee for Islamic Research and Ifta’ was asked: Does touching a child’s private parts while changing their clothes invalidate wudu?
They replied: “Touching the private parts without a barrier invalidates wuḍū, whether the person is a child or an adult. This is based on the report that the Prophet ﷺ said: ‘Whoever touches his private parts should perform wuḍū, for the private parts touched are the same as the private parts of one who is adult.” [Fatawa Al-Lajnah Ad-Da’imah, 5/265]
2⃣. Second Opinion: wuḍū is not invalidated by touching the private parts of a child.
Ibn Qudamah rahimahullāh said: “According to Az-Zuhri and Al-Awza‘i, wuḍū is not required for touching a child’s private parts, because it is permissible to touch and look at them.” [Al-Mughni 1/118]
Shaykh Ibn ‘Uthaymeen rahimahullāh was asked: Does washing the private parts of a child invalidate wudu?
He replied: “No. Touching the private parts of a child does not invalidate wuḍū. wuḍū is invalidated by touching an adult’s private parts only if it is done with desire. This reconciles the narrations of Talq ibn ‘Ali and Busrah bint Safwan. Talq ibn ‘Ali’s narration: ‘If a man touches his penis during prayer, does his wuḍū break? He said: No, it is only a part of you.’ Busrah’s narration: ‘Whoever touches his penis should perform wuḍū.’ Thus, if it is done without desire, wuḍū is not required. If it is done with desire, wuḍū becomes obligatory because something may be discharged without one realising it. In summary: touching the private parts of a child while washing him does not invalidate wuḍū, because there is no desire involved.” [Liqa’ Al-Bab Al-Maftuh]
Conclusion (The Stronger Opinion): The wuḍū of a mother is not invalidated when she touches the private parts of her child, as this is a necessity that occurs frequently. There is no report that the Prophet ﷺ instructed the wives of the Companions to renew wudu every time they touched their children’s private parts, despite this being a common situation.
