What is Nushūz?
Linguistically, nushūz denotes obstinacy, disobedience, and arrogance. It is derived from nashz, meaning that which is elevated or raised above the ground.
[Tahdhīb Al-Lughah by Al-Azhari, 11/209; As-Sihāh by Al-Jawhari, 3/899]
Legislatively, nushūz refers to a wife’s disobedience toward her husband in matters in which Allāh has enjoined her to obey him. A nāshiz woman is one who elevates herself above her husband, neglects his commands, and turns away from him.
[Al-Mughnī of Ibn Qudāmah, 7/318]
Sheikh Muhammad Ameen Ash-Shinqīṭī raḥimahullāh said:
“The root meaning of nushūz in the Arabic language is elevation. Thus, a nāshiz woman is likened to one who rises above the place where her husband lies with her. In the terminology of the fuqahā, it refers to a wife’s departure from obedience to her husband. Likewise, a husband’s nushūz is his rising above the place where his wife is and abandoning intimacy with her. And Allāh, Exalted be He, knows best.”
[Aḍwā’ Al-Bayān, 1/241]
