The presence of a baby does not remove khalwa Imam An-Nawawi rahimahullah said: «لا يخلون رجل بامرأة إلا ومعهما ذو محرم: وأما إذا خلا الأجنبي بالأجنبية من غير ثالث معهما، فهو حرام باتفاق العلماء، وكذا لو كان معهما من لا يستحيى منه لصغره كابن سنتين وثلاث ونحو ذلك، فإن وجوده كالعدم» “A man must not be alone with a woman except in the presence of her mahram. If a non-mahram man is alone with a woman without a third person present, it is forbidden by scholarly consensus. Likewise, if the only one present is a small child, such as a two- or three-year-old, who is not shyed away from, then their presence is considered as non-existent.” [Sharh Muslim (9/109)]
