He (peace be upon him) also said: "O Allah, I declare as sacred the rights of two weak ones: the orphan and the woman." Narrated by Ahmad (no. 9666) and Ibn Majah (no. 3678), authenticated by Ibn Hibban (no. 5565) and Al-Hakim (nos. 211, 7167) with Adh-Dhahabi agreeing, and Al-Albani graded its chain as hasan in "As-Sahihah" (no. 1015).
The Eighth Aspect: Divorcing a woman without reason or need is an instigation from Shaytan. Shaytan loves this and is delighted by it. Allah Almighty said: "O you who have believed, do not follow the footsteps of Shaytan. And whoever follows the footsteps of Shaytan—indeed, he enjoins immorality and wrongdoing. And if not for the favour of Allah upon you and His mercy, not one of you would have been pure, ever. But Allah purifies whom He wills, and Allah is Hearing and Knowing" [Surah An-Nur: 21].
Muslim (no. 2813) narrated from Jabir (may Allah be pleased with him) that the Messenger of Allah (peace be upon him) said: "Iblis places his throne on the water, then sends out his troops. The closest to him in rank are those who cause the greatest tribulation. One of them comes and says: 'I did such and such.' He says: 'You have done nothing.' Then another comes and says: 'I did not leave him until I separated him from his wife.' He says: 'You are the best,' and brings him close." Al-A'mash said: "I think he said, 'he embraces him'"—meaning he pulls him to himself and hugs him.
The Ninth Aspect: It involves ingratitude for a blessing. Marriage is a blessing from Allah Almighty upon His servants. Allah Almighty said: "And among His signs is that He created for you from yourselves mates" [Surah Ar-Rum: 21]. Allah Almighty also said: "Beautified for people is the love of that which they desire—of women..." [Surah Al-Imran: 14]. Ingratitude for a blessing is forbidden.
The Tenth Aspect: It involves nullifying a recommended marriage; it is not permissible except in cases of necessity. As-Sarakhsi mentioned this aspect and the previous one in "Al-Mabsut" (vol. 2, p. 6).
Mulla Ali Al-Qari (may Allah have mercy on him) mentioned in "Mirqat Al-Mafatih" (vol. 5, p. 2137) the two hadiths of Thawban and Abu Hurayrah mentioned earlier in the fifth aspect, which indicate the prohibition of khul' without a valid reason. Then he said concerning divorce without need: "It is prohibited because it involves ingratitude for the blessing of marriage, and because of the two mentioned hadiths and others. It is only permitted when there is a need. The need is deliverance when there is a clash of temperaments and the occurrence of hatred that leads to the inability to uphold Allah's limits. So He legislated it as a mercy from Him, the Glorified. Thus there is a conflict between the two rulings. The correct view is that it is prohibited except in cases of need, due to the aforementioned evidence." He (may Allah have mercy on him) also said: "But when there is no need, it is pure ingratitude for a blessing and bad manners, so it is disliked. And Allah Almighty knows best." End of his words (may Allah have mercy on him).
The Eleventh Aspect: Divorcing a woman without reason or need is not part of the excellence regarding which the Prophet (peace be upon him) said: "The best of you are those best to their families, and I am the best of you to my family." Narrated by At-Tirmidhi (no. 3895), who authenticated it. It was also authenticated by Ibn Hibban (no. 4177), Al-Albani in "As-Sahihah" (nos. 285, 1174), and Al-Wadi'i in "As-Sahih Al-Musnad mimma laysa fi As-Sahihayn" (no. 1595), who said it is upon the condition of the two Shaykhs (Bukhari and Muslim).
