Wisdom and Restraint in Matters of Divorce
Sheikh Abu 'Amr Al-Hajoori hafidhahullah said:
A sensible man does not issue a divorce unless the woman is truly not suitable. He should be patient with her, advise her, and try to fix things. But if every time he gets angry he says, βYou are divorced,β this is what leads to disputes and problems. Then he reaches the third divorce and says, βI didnβt mean it.β Then what did you mean? Are you joking or trying to build a home when you say, βYou are divorcedβ?
Likewise, as mentioned about women, when a woman becomes angry, she may easily ask for divorce or khulβ. This matter (of khul') should be controlled and handled properly, ideally in front of a judge.
The Prophet ο·Ί said: βThe women who seek khulβ (divorce) without a valid reason are hypocrites.β So it is not allowed for a woman to ask for divorce unless there is something in the religion that she truly cannot bear.
As for misunderstandings, bad behaviour, or similar issuesβthese happen between people, and perhaps she herself may have even worse behaviour. What is needed is patience. Each person should be patient with the other, except in matters that truly cannot be tolerated.
