The “Ḥaleel” and the One for Whom He Acts as Ḥaleel
It is reported in Sunan At-Tirmidhi with an authentic chain from Ibn Masʿud (may Allāh be pleased with him) that the Messenger of Allāh ﷺ said:
“May Allāh curse the ḥaleel and the one for whom he acts as ḥaleel.”
Explanation:
This ḥadīth indicates that the act of taḥleel marriage is a major sin, as the Prophet ﷺ explicitly cursed those who engage in it.
The Ḥaleel: The man who marries a divorced woman with the intention of divorcing her so she becomes lawful again for her first husband.
The one for whom he acts as Ḥaleel: The first husband who receives the woman back.
Ibn ʿAbdil-Hādi said:
“The act of the ḥaleel is among the major sins because it is pure fornication without dispute.”
Prominent scholars such as An-Nawawi, Adh-Dhahabi, Ibn Al-Qayyim, Ibn ʿAbdil-Hadi, Ibn An-Nuḥās, Al-Haytami, and Al-Hajjawi — may Allāh have mercy on them — have all classified taḥleel marriage among the major sins.
