NOTE: The Fiqh principle states: أن ما ترتَّب على المأذونِ فإنه غير مضمون. "What arises from what is permitted is not subject to liability." NOTE: The criterion for negligence: ضابط التفريط: لم يعمل ما يوجب حفظه شرعا/عرفا Failure to take the necessary actions required by law or customary practice to ensure its safekeeping. 3. Lending (الإعارة) is a non-binding contract, meaning the lender (المعير) has the right to revoke it at any time unless doing so would cause harm to the borrower. If revoking the loan would result in harm, then withdrawal is not permissible. ((لا ضَرَر ولا ضِرَار)) EXAMPLE: Person A lends his car to person B to travel to a different city and return, but after reaching that city, the borrower says, “I don't want to use your vehicle any longer,” this would cause harm to the lender, and vice versa. 4. The loan arrangement ends, and the borrowed item must be returned in the following cases: - If the owner demands its return, even if the borrower has not yet fully benefited from it. - Once the intended purpose of borrowing the item has been fulfilled. - Upon the expiration of the agreed loan period if it was time-limited. - Upon the death of either the lender or the borrower, as this nullifies the loan agreement. 5. The borrower has the right to benefit from the borrowed item in the same way as a tenant (المستجير), meaning he may use it personally or allow someone else to use it on his behalf, as long as this is within the permitted scope of usage a and permission is explicitly granted by the owner. _ Source: T.me/masjidsahabah https://whatsapp.com/channel/0029VadAK4n5K3zclcMjeg0F
