BENEFIT: The responsibility of safeguarding orchards/farms during the day falls upon their owners, as they are awake and able to protect them. Additionally, livestock are typically released during the daytime for grazing, making it the duty of land owners to remain vigilant and protect their properties. Therefore, they are accountable for their farms. At night, however, livestock do not need to be released; instead, they remain in their designated enclosures—in their pens if they are camels, and in their yards if they are other types of livestock. This is supported by the saying of the Prophet ﷺ: ((من أريد ماله بغير حق، فقاتل فقتل فهو شهيد)) "Whoever is wrongfully attacked for his wealth and fights back, and is killed, he is a martyr." [Reported by al-Tirmidhi, no. 1420, classified as Hasan Sahih; also recorded by Ibn Majah, no. 2582, with a sound chain of transmission authenticated by al-Albani in Sahih At-Tirmidhi, no. 1147)]. NOTE: The term صائل (aggressor) refers to a person who unlawfully assaults another with the intent to harm them, their family, or their property. NOTE: Self-defense is permitted in Islam, as long as it is proportionate to the threat. According to most scholars, if someone kills a صائل in self-defense, they will be held liable for murder unless they can prove that the person was indeed a صائل and that this act was proportionate to the threat. Whoever destroys what Allāh has forbidden—such as musical instruments, crosses, vessels used for alcohol, books of misguidance and innovation, as well as tapes and magazines promoting immorality and indecency—bears no liability. However, such destruction should not be carried out indiscriminately; rather, it must be done with the authorisation of the ruler and under his supervision. This ensures the protection of public interest, the prevention of harm, and the avoidance of discord and unrest. _ Source: T.me/masjidsahabah https://whatsapp.com/channel/0029VadAK4n5K3zclcMjeg0F
