ADDITIONAL NOTES:
1. The seller does not have the right to retain ownership of the sold item after the sale. For instance, he is not allowed to say: "Ownership will only transfer to the buyer once all installments are paid." However, it is permissible for the seller to stipulate a restriction on resale, meaning that ownership transfers to the buyer, but the buyer is prohibited from selling the item until all installments are paid. This is what the jurists refer to as:
رهن المبيع على ثمنه.
2. It is forbidden for the buyer to deliberately delay the payment of due installments without valid excuse. If they have a valid excuse the seller should be patient as Allāh ﷻ said:
﴿وَإِن كَانَ ذُو عُسۡرَةࣲ فَنَظِرَةٌ إِلَىٰ مَیۡسَرَةࣲۚ وَأَن تَصَدَّقُوا۟ خَیۡرࣱ لَّكُمۡ إِن كُنتُمۡ تَعۡلَمُونَ﴾
"And if the debtor is in a hard time (has no money), then grant him time till it is easy for him to repay, but if you remit it by way of charity, that is better for you if you did but know." [Surah Al-Baqarah: 280]
3. It is permissible for the seller in an installment sale to stipulate that all installments become due immediately if the debtor delays payment of any installment ما لم يكن معسراً, provided the debtor agrees to this condition at the time of contracting.
4. Reducing the deferred debt for early payment, whether initiated by the creditor or the debtor (known as early payment discount), is permissible.
