Thus, a buyer must take full possession of an item before reselling it. NOTE: Ibn Qudamah rahimahullah said in Al-Mughni: «قبض كل شيء بحسبه، فإن كان المبيع دراهم أو دنانير، فقبضها باليد، وإن كان ثيابا فقبضها نقلها، وإن كان حيوانا، فقبضه تمشيته من مكانه، وإن كان مما لا ينقل ويحول، فقبضه التخلية بينه وبين مشتريه لا حائل دونه، لأن القبض مطلق في الشرع، فيجب الرجوع فيه إلى العرف» "The manner of taking possession differs depending on the item. If the sold item is silver or gold coins, possession is taken by physically receiving them. If it is clothing, possession is taken by transferring or moving them. If it is an animal, possession is taken by leading it away from its place. If it is something immovable, possession is taken by enabling the buyer to access it without any obstacles. Since 'possession' is left undefined in the Sharī‘ah, customary practice must be referred to." ____ 7⃣. بيع الثمار قبل بدو صلاحها Selling Fruits Before They Ripen It is impermissible to sell fruits before their ripeness becomes apparent, as this may lead to disputes if the fruit spoils or develops defects before harvest. Anas (may Allāh be pleased with him) narrated that the Messenger of Allāh ﷺ said: أنَّ رسولَ اللهِ ﷺ نهى عن بيعِ الثِّمارِ حتَّى تُزهيَ قيل: وما تُزهي ؟ قال: حتَّى تحمَرَّ قال رسولُ اللهِ ﷺ: ((أرأَيْتَ إذا منَع اللهُ الثَّمرةَ بمَ يأخُذُ أحدُكم مالَ أخيه؟)) “The Messenger of Allāh ﷺ forbade the sale of fruits until they begin to ripen. It was asked, "What does 'ripen' mean?" He replied, "Until they turn red." The Messenger of Allāh ﷺ then said: "What if Allāh prevents the fruit (from ripening)? How could one of you take his brother’s wealth unjustly?” [Narrated by Bukhari & Muslim] Ibn ’Umar (may Allāh be pleased with him) narrated: ((أنَّ رسولَ الله ﷺ نَهى عن بيعِ الثِّمارِ حتَّى يبدوَ صلاحُها نَهى البائعَ والمبتاع)) "The Messenger of Allāh ﷺ prohibited the sale of fruits until their ripeness becomes apparent. He prohibited both the seller and the buyer from engaging in such transactions." [Narrated by Bukhari & Muslim] The ripeness of fruits is determined by visible signs, such as: - For dates: When their colour changes to red or yellow. - For grapes: When they turn black and sweetness becomes apparent. - For grains: When they dry and harden. Similar criteria apply to other types of fruits. ____ 8⃣. النجْش Deceptive Price Inflation Najsh refers to a person artificially increasing/decreasing the price of an item in a sale (commonly in auction) without intending to purchase it. This is done to deceive others into believing the item is more/less valuable than it actually is, thereby inducing higher/lower bids/offers. Ibn ’Umar (may Allāh be pleased with him) narrated: ((نهى النبيُّ ﷺ عَنِ النَّجْشِ)) "The Messenger of Allāh ﷺ prohibited An-Najsh."
