SPECIFYING THE مثمَن:
27 November 2025 • 534 views
The item sold must be known to both the buyer and seller either through:
(1) direct observation, or
(2) a clear description that distinguishes it from others.
SPECIFYING THE ثمن:
The price of the item must be clearly known by specifying its value and currency at the time of the transaction, such as a price tag.
Ambiguity (جَهالة) relating to the item or price is a type of gharar. Thus, it is invalid to sell something unseen, unknown, or absent from the place of the transaction without proper specification. Just as it is forbidden to sell an item at an unspecified price.
BENEFIT: Sheikh Al-Islam Ibn Taymiyyah raḥimahullāh states:
«لو باع ولم يسم الثمن: صح بثمن المثل، كالنكاح»
"If a sale is conducted without specifying the price, it is valid at the market price, similar to (Mahr in) marriage."
[الاختيارات ضمن الفتاوى الكبرى (5/ 387)]
According to this opinion, it is sufficient for the contracting parties to agree on a regulated method for determining the price even if the price is not specified. However, this approach is highly likely to lead to disagreement, especially if there's a variance in the market prices.
