This includes the seller, the buyer, and anyone acting on their behalf. BENEFIT: There are five types of individuals who can act on behalf of the buyer or seller: I1l الوكيل = agent I2l الوصي = the executor in matters related to one-third of the estate after death, I3I ناظر الوقف = the guardian of a waqf I4I القاضي = the judge in matters concerning the legally incapacitated, I5I الولي = the guardian of an orphan, a foolish person, or the insane. [The first three are authorised by the owner, while the others are authorised by the Shari'ah]. The 2nd Pillar: The Object of the Contract This refers to the items being exchanged: (a) الثَّمَن price (b) المُثْمَن commodity The 3rd Pillar: The Terms of the Contract These terms can be expressed either verbally or through action. - Verbal Agreements comprise: (a) الإيجاب (The Offer) – A statement made by the seller, such as, "I sell." (b) القَبول (The Acceptance) – A statement made by the buyer, such as, "I buy." Together, these form the verbal terms of the agreement. Note: Any expression conveying the same meaning can be used. These verbal terms can also be replaced by المعطاة (The Act of Giving and Taking). For example, when the seller hands the item to the buyer, and the buyer pays without any verbal exchange, this is sufficient. _____ Source: https://t.me/masjidsahabah https://whatsapp.com/channel/0029VadAK4n5K3zclcMjeg0F
