🎁 Some benefits from our Shayk Abū Bilāl's class 🎁 📕 Rulings Of The Qurān by Al-Imām Ibn Al-Arabē. Allāh ﷻ says: {يَٰٓأيُّهَا ٱلَّذِينَ ءَامَنُوٓا۟ إذَا ضَرَبْتُمْ فِى سَبِيلِ ٱللَّهِ فَتَبَيَّنُوا۟ وَلَا تَقُولُوا۟ لِمَنْ ألْقَىٰٓ إِلَيْكُمُ ٱلسَّلَٰمَ لَسْتَ مُؤْمِنًا} {"Oh you who believe, when you set out [to fight] in the cause of Allah, investigate; and do not say to one who gives you [a greeting of] peace "You are not a believer"} (An-Nisā: 94) Some of the scholars have mentioned three pathways through which a person is legally classed as a Muslim: 📌 The Declaration and it is to state the two testimonies (I bear witness that none has the right to be worshipped except Allāh (alone) and that Muhammad is his Messenger (ﷺ) (1) 📌 By extension and this applies to the young children of Non-Muslims who have not reached puberty when the father and mother become Muslim. (2) 📌 By indication and it is by doing an action that is specific to the Muslims. (3) _____________________________________ Our Shayk Abū Bilāl (may Allāh preserve him) said: (١.) Such is the case for whoever says "I am a Muslim" or "I have submitted" for indeed these statements contain the meaning of the testimony 'None has the right to be worshipped excepted Allāh (alone) so whoever said it is given the ruling of a Muslim due to the hadith of Al-Meqdād Ibn Al-Aswād: [قَالَ لِرَسُولِ اللَّهِ ﷺ: "أرَأيْتَ إنْ لَقِيتُ رَجُلًا مِنَ الْكُفَّارِ، فَاقْتَتَلْنَا، فَضَرَبَ إحْدَى يَدَيَّ بِالسَّيْفِ، فَقَطَعَهَا، ثُمَّ لَاذَ مِنِّي بِشَجَرَةٍ، فَقَالَ : أسْلَمْتُ لِلَّهِ. أأقْتُلُهُ يَا رَسُولَ اللَّهِ بَعْدَ أنْ قَالَهَا ؟ فَقَالَ رَسُولُ اللَّهِ ﷺ : " لَا تَقْتُلْهُ ؛ فَإِنْ قَتَلْتَهُ فَإِنَّهُ بِمَنْزِلَتِكَ قَبْلَ أنْ تَقْتُلَهُ، وَإِنَّكَ بِمَنْزِلَتِهِ قَبْلَ أنْ يَقُولَ كَلِمَتَهُ الَّتِي قَالَ "] [He said to Allāh's Messenger ﷺ, "Tell me, O Messenger of Allah, if I meet a disbeliever, and we fight one another, and he cuts off one of my hands with his sword, then hides from me behind a tree and (then) says he has submitted himself to Allah; Shall I kill him after he has said it?" Allāh' Messenger (ﷺ) said "Do not kill him, for if you do so, he will be in the position in which you were before you killed him (i.e. a Muslim whose blood is sacred), and you will be in the position in which he was before he made his testimony (i.e. your blood will not be sacred because his heirs can ask for Qisas)".] (Al-Bukhāri 4019 and Muslim 95). So within this is an indication that whoever says "I have submitted" is given the legal ruling of a Muslim. (٢.) If the two become Muslim there is no problem, likewise if the father alone becomes Muslim. However, the difference of opinion is regarding the mother. From the people of knowledge are those that say the mother (alone) is not sufficient for the children to be classed as Muslim. What is apparent is that if they are under the care of the mother then they follow her. (٣.)
