36. Forty Days: The Usual Maximum Postpartum
عَنْ مُسَّةَ الأَزْدِيَّةِ عَنْ عَنْ أُمِّ سَلَمَةَ قَالَتْ: ((كَانَتِ النُّفَسَاءُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ تَقْعُدُ بَعْدَ نِفَاسِهَا أَرْبَعِينَ يَوْمًا، أَوْ أَرْبَعِينَ لَيْلَةً))
Umm Salamah said: ‘During the time of Allah’s Messenger ﷺ, women who had just given birth would remain after childbirth (without praying) for forty days or forty nights.’ [Reported by Abu Dawud (311), and graded as hasan by Sheikh Al-Albani]
Brief commentary:
1. Some have criticised this hadith due to Mussah, the mother of Bussah, claiming that she is unknown. However, this was answered in Al-Badr Al-Munir, where it says: “We do not accept that she is completely unknown. Her status as an unknown narrator is removed because several scholars narrated from her, including Kathir ibn Ziyad, Al-Hakam ibn ‘Utaybah, and Zayd ibn ‘Ali ibn Al-Husayn. Also, Muhammad ibn ‘Ubaydullah Al-‘Azrami narrated it from Al-Hasan from Mussah. So a number of narrators reported from her. Al-Bukhari praised her hadith, and Al-Hakim declared its chain authentic. At the very least, the hadith can be considered hasan.” End of quote.
2. Nifās is the blood expelled due to childbirth. When a woman gives birth, she is called nufasā’ (a postpartum woman), and the plural is nifās. This word has a rare plural form in Arabic. It can also be pluralised as nufasāwāt.
3. The statement: “She would remain sitting” means: She is not allowed to pray, fast, perform tawaf or have sexual relations.
4. The “or forty nights” most likely indicates a doubt from one of the narrators (either Zuhayr or someone after him).
5. Most scholars say that a woman remains in a postpartum state for up to 40 days, unless the bleeding stops earlier. If it continues beyond 40 days, they consider it irregular bleeding, meaning she should perform a ritual bath (ghusl) and resume prayer.
However, a stronger opinion is that there is no fixed maximum duration. According to this view, even if the bleeding continues after 40 days, it is still considered postpartum bleeding as long as it has the same characteristics as menstrual blood. This view is stronger because Islamic law bases the ruling on whether the blood is present or not, rather than setting a strict time limit.
Ibn Taymiyyah (may Allah have mercy on him) said: “There is no minimum or maximum limit for postpartum bleeding. Even if it goes beyond forty, sixty, or seventy days and then stops, it is still postpartum bleeding. But if it continues without stopping, then it becomes irregular bleeding. However, forty days is the usual maximum.”
Note: If bleeding continues beyond 40 days, it is possible that her regular menstrual cycle has started again without her realising, since the two types of blood look alike.
6. If a woman has a miscarriage, the bleeding is not considered nifās unless the fetus shows clear human features.
