Forty Cubits: The Protected Zone of a Well From 'Abdullah ibn Mughaffal (may Allah be pleased with him) that the Prophet ﷺ said: ((مَنْ حَفَرَ بِئْرًا، فَلَهُ أَرْبَعُونَ ذِرَاعًا عَطَنًا لِمَاشِيَتِهِ)). “Whoever digs a well has the right to forty cubits of surrounding space for watering his animals.” [Reported by Ibn Majah (2032), authenticated by Sheikh Albani] Brief Commentary: 1. The Prophet ﷺ explained how people should deal with one another in matters where disputes may arise, such as the protected areas around trees, palm trees, wells, springs, and similar things. 2.“Whoever digs a well…” means: if a person digs a well in unused land that does not belong to anyone, “he has forty cubits,” meaning he is entitled to forty cubits of space—either from each side or around it, “as a resting and watering place for his animals,” meaning a space where his animals can gather and drink. This is because the owner of the well needs space when watering his animals, especially as they gather around the water. 3. This area is considered the protected boundary of the well dug in unused land.
