31. Silver Zakah: One Dirham for Every Forty
Habib Al-Maliki said: A man said to 'Imran ibn Husayn (may Allah be pleased with him):
يَا أَبَا نُجَيْدٍ، إِنَّكُمْ لَتُحَدِّثُونَنَا بِأَحَادِيثَ مَا نَجِدُ لَهَا أَصْلًا فِي الْقُرْآنِ. فَغَضِبَ عِمْرَانُ وَقَالَ لِلرَّجُلِ: أَوَجَدْتُمْ فِي كُلِّ أَرْبَعِينَ دِرْهَمًا دِرْهَمٌ، وَمِنْ كُلِّ كَذَا وَكَذَا شَاةً شَاةٌ، وَمِنْ كُلِّ كَذَا وَكَذَا بَعِيرًا كَذَا وَكَذَا، أَوَجَدْتُمْ هَذَا فِي الْقُرْآنِ؟ قَالَ: لَا. قَالَ : فَعَنْ مَنْ أَخَذْتُمْ هَذَا؟ أَخَذْتُمُوهُ عَنَّا وَأَخَذْنَاهُ عَنْ نَبِيِّ الله ﷺ. وَذَكَرَ أَشْيَاءَ نَحْوَ هَذَا.
“O Abu Nujayd, you narrate to us sayings that we don’t find mentioned in the Qur’an.” 'Imran became upset and said to him, “Did you find in the Qur’an that for every forty dirhams there is one dirham (to be given in Zakah), or that for such-and-such number of sheep there is one sheep due, or for such-and-such number of camels there is such-and-such (due)? Did you find this in the Qur’an?” The man said, “No.” 'Imran said, “Then from whom did you take this? You took it from us, and we took it from the Prophet ﷺ.” He mentioned other similar examples as well.
[Reported by Abu Dawud (1561), and he did not comment on it سكت عنه. He stated in his letter to the people of Makkah that anything he remained silent about is (acceptable). It was also reported by Ibn Battah in Al-Ibanah (hadith no. 66, pp. 234–235), and by Ibn Abdil Barr in Jami‘ Bayan Al-‘Ilm (2/1192) in a shorter form. The Muhaqqiq of Al-Ibanah said: its chain of narration is acceptable. And the Muhaqqiq of Jami‘ Bayan Al-‘Ilm considered it strong]
Brief Commentary:
Sheikh 'AbdulMuhsin Al-'Abbad hafidhahullah comments:
"The Sunnah, as is well known, was learned by the companions of the Messenger of Allah ﷺ directly from him, just as they learned the Qur’an. They are the ones who conveyed both the Book and the Sunnah. The Prophet ﷺ said: “I have been given the Qur’an and something like it along with it,” meaning the Sunnah. It is known that the Sunnah is also revelation from Allah, just as the Qur’an is revelation. The difference is that the Qur’an is recited in worship and is miraculous, while both the Qur’an and the Sunnah must be followed and acted upon. There is no separation between them.
The Sunnah is also included within the Qur’an and is commanded in it, as Allah says: “Whatever the Messenger gives you, take it; and whatever he forbids you from, leave it.” So all of the Sunnah falls under this verse.
It is reported from ‘Abdullah ibn Mas‘ud (may Allah be pleased with him) that when he mentioned the woman who plucks eyebrows and the one who has it done, he said: “Why should I not curse those whom the Messenger of Allah ﷺ cursed, when it is in the Book of Allah?” A woman heard this and said, “O Abu ‘Abdurrahman, you said such-and-such, but I read the Qur’an from beginning to end and did not find mention of this.” He replied, “If you had read it properly, you would have found it. Allah says: ‘Whatever the Messenger gives you, take it; and whatever he forbids you from, leave it.’”
Similarly, [in this hadith] when ‘Imran (may Allah be pleased with) was asked, he became upset and said: where did you find in the Qur’an the exact amounts for zakah? These details are not found in the Qur’an; they are found in the Sunnah.
For example, the specific amounts for camels or sheep and what is due on them are not mentioned in the Qur’an. Rather, the Sunnah explains the Qur’an, clarifies it, and guides to its meaning. It is closely connected to the Qur’an, and acting upon it is an act of worship just like acting upon the Qur’an. The Qur’an itself commands us to follow the Sunnah.
In fact, rejecting the Sunnah is rejecting the Qur’an, and denying the Sunnah is denying the Qur’an.
