"I Marry You to Myself!"
Imam Al-Bukhāri raḥimahullāh has a chapter titled:
باب إذا كان الولي هو الخاطب
“Chapter: When the Guardian Is the One Proposing Marriage.”
In this chapter he discusses the case where a woman’s guardian (walī) is himself the one proposing marriage to her.
Examples of such a case include:
-> if a cousin (who is lawfully permitted to marry her) assumes guardianship
-> or a woman entrusts her marital decision to a man and grants him guardianship in that matter.
Al-Bukhāri cites several reports from the Companions to show that such a marriage is valid.
For example, Al-Mughīrah ibn Shu‘bah proposed to his cousin and appointed another man to conduct the marriage contract on his behalf.
In another case, ‘Abdurraḥmān ibn ‘Awf was given authority by a woman to decide her marriage, and he married her himself.
Scholars explain that if the guardian is the prospective husband, he may either conduct the marriage contract himself or appoint someone else to do so. Both options are permissible. Most scholars hold that it is not obligatory for him to appoint another person, though witnesses should be present to attest to the contract.
When the guardian and the groom are the same person, the offer and acceptance may occur in a single wording, eg:
زوجتك نفسي
“I marry you to myself”
