It is not permissible to bypass the nearest wali unless he is absent or does not meet the required conditions. The order of guardianship is as follows: 1. Her father, followed by his appointed guardian. 2. Her paternal grandfather, regardless of how far back in lineage. 3. Her son. 4. Her grandsons and their descendants, regardless of how far down in lineage. 5. Her full brother. 6. Her paternal half-brother. 7. The sons of her full or paternal half-brother. 8. Her paternal uncle (father’s full brother). 9. Her paternal uncle (father’s paternal half-brother). 10. The sons of her paternal uncles. 11. The closest male relative among the male heirs, in accordance with the laws of inheritance. 12. If no eligible guardian is available, the Muslim ruler. So, the brother can be the wali if everyone preceding him is not Muslim, and he fits the conditions of a valid wali (see here https://t.me/madrasatuna/4455) وفقك الله
