A1. Costco Membership There is a difference of opinion between the scholars regarding these kind of memberships. I asked Shaykh Sa'd Ash-Shitri about it before, and he mentioned that it is PERMISSIBLE. I believe this is the stronger opinion since membership gives you access to their facilities at various locations, which is a recognised type of منفعة (benefit) according to عرف (customs). _ Similar types of subscriptions include Gym membership, Amazon Prime, Uber Eats, etc. Amazon Prime is permissible due to the following reasons: 1: It is payment in exchange for a defined/known benefit, which is to have access to free deliveries at any time in the month or to have access to prioritize delivery for that month for any orders made. 2: The basis of the contract is not built upon ambiguity, rather the ambiguity is in secondary affairs such as delivery/shipping and promotional offers given to members 3: The ambiguity is limited and not general 4: These type of memberships were introduced due to the general demand in the market for such services. There is mutual benefit for members as well as the providers. 5: Membership give members a multitude of offers in return. 6: A relative example is a person renting a house and he is told if you pay $100 extra you will get access to the landlord's car. 7: These transactions are widespread in the land of the Muslims and the kuffar and no one from the scholars has yet to clearly declare them as impermissible -according to what has been researched, whereas there are scholars who have permitted them. ____ A3.
