Sheikh Al-Fawzān comments:
These مكوس are what we now refer to as جمارك (customs duties), and they are indeed a calamity. This is because they involve the unjust taking of wealth without right. However, the silence of scholars on this matter does not indicate its permissibility, for the reasons I have mentioned to you. Either their views are not considered, or they are not heeded, or they lack the strength and courage to address the issue. Yes, either they lack the strength and courage to speak out.
These مكوس/customs duties are undoubtedly prohibited, but they are less severe than shirk. Remaining silent on this matter is less serious than remaining silent on shirk.
Reader: "Let me give you an example related to that."
Sheikh Fawzān: An example related to scholars' silence, whether or not it can be considered as proof.
Reader: "This example is المكوس (tax) referred to as "المجابي. It is a known and fundamental principle of the religion that these taxes are forbidden."
Sheikh Fawzān: As they involve the unjust taking of wealth. However, it is said that these are part of an international system..., or that they are necessary for the protection of local products. They cannot protect their products except through this means?!
Reader: "Despite it being a well-known principle of religion that these taxes are prohibited, they have become prevalent and widely accepted in the various land and regions, to the point that its condemnation hardly reaches anyone’s ears. The hands of the tax collectors have even extended to the holiest of places, in Makkah, the Mother of Cities."
Sheikh Fawzān: Yes, during his time. They would take money from pilgrims, forcing them to pay a duty before performing Hajj.
