Do I need permission from my husband to make up missed fasts? โ— If the husband is ABSENT (i.e. travelling, working the whole day, with another wife), the woman does not need to seek permission whatever the fast. โ— If husband is PRESENT, then it is forbidden for a woman to fast without his permission. The proof for these two cases is the แธฅadฤซth of Abลซ Hurairah raแธhiyallฤhu โ€™anhu: that the Messenger of Allah ๏ทบ said: ((ู„ุงูŽ ูŠูŽุญูู„ู‘ู ู„ูู„ู’ู…ูŽุฑู’ุฃูŽุฉู ุฃูŽู†ู’ ุชูŽุตููˆู…ูŽ ูˆูŽุฒูŽูˆู’ุฌูู‡ูŽุง ุดูŽุงู‡ูุฏูŒ ุฅูู„ุงู‘ูŽ ุจูุฅูุฐู’ู†ูู‡ู)). โ€œIt is not permissible for a woman to fast without the permission of her husband when he is at home.โ€ [Reported by Bukhari (5195) and Muslim (1026)] Imฤm An-Nawawi raแธฅimahullฤh explained (Sharแธฅ Muslim (7/115)]: ยซู‡ุฐุง ู…ุญู…ูˆู„ ุนู„ู‰ ุตูˆู… ุงู„ุชุทูˆุน ูˆุงู„ู…ู†ุฏูˆุจ ุงู„ุฐูŠ ู„ูŠุณ ู„ู‡ ุฒู…ู† ู…ุนูŠู†ุŒ ูˆู‡ุฐุง ุงู„ู†ู‡ูŠ ู„ู„ุชุญุฑูŠู… ุตุฑุญ ุจู‡ ุฃุตุญุงุจู†ุงุŒ ูˆุณุจุจู‡ ุฃู† ุงู„ุฒูˆุฌ ู„ู‡ ุญู‚ ุงู„ุงุณุชู…ุชุงุน ุจู‡ุง ููŠ ูƒู„ ุงู„ุฃูŠุงู…ุŒ ูˆุญู‚ู‡ ููŠู‡ ูˆุงุฌุจ ุนู„ู‰ ุงู„ููˆุฑ ูู„ุง ูŠููˆุชู‡ ุจุชุทูˆุน ูˆู„ุง ุจูˆุงุฌุจ ุนู„ู‰ ุงู„ุชุฑุงุฎูŠยป โ€œThis (seeking permission) applies with voluntary and recommended fasts that do not have a specific time (as opposed to fasting Arafah, Ashooraa', etc), and this prevention indicates prohibition as has been stated by our companions (i.e. the Shaafi'iyyah), and the reason for this is that the husband has the right to enjoy her everyday, and fulfilling his right is an immediate obligation which must not be abandoned for voluntary or non-immediate obligatory [acts of worship].โ€ โ— Non-immediate obligatory fasting would include: 1. Fasting in fulfilment of a vow (as long as it's not constricted by time) 2. Repayment of missed Ramadhan fasts (as long as she doesn't delay it till Sha'ban) Al-Haytami rahimahullah stated: ยซูˆูŠุญุฑู… ุนู„ู‰ ุงู„ุฒูˆุฌุฉ ุฃู† ุชุตูˆู… ุชุทูˆุนู‹ุง ุฃูˆ ู‚ุถุงุกู‹ ู…ูˆุณุนู‹ุง ูˆุฒูˆุฌูู‡ุง ุญุงุถุฑูŒ ุฅู„ุง ุจุฅุฐู†ู‡ุŒ ุฃูˆ ุนูู„ู’ู…ู ุฑุถุงู‡ยป โ€œIt is forbidden for a wife to fast voluntarily or make up obligatory fasts which have an extended timeframe (i.e. Non-immediate) while her husband is present, except with his permission, or knowledge of his approval.โ€ [ุชุญูุฉ ุงู„ู…ุญุชุงุฌ ููŠ ุดุฑุญ ุงู„ู…ู†ู‡ุงุฌ] Similarly, Ibn แธคajar mentioned [Fatแธฅul Bฤri] that: ยซู‚ูˆู„ู‡ ุฅู„ุง ุจุฅุฐู†ู‡ ููŠ ุบูŠุฑ ุตูŠุงู… ุฃูŠุงู… ุฑู…ุถุงู† ูˆูƒุฐุง ููŠ ุบูŠุฑู‡ ู…ู† ุงู„ูˆุงุฌุจ ุฅุฐุง ุชุถุงูŠู‚ ุงู„ูˆู‚ุชยป โ€œHis saying (๏ทบ) <Except with His permission> does not apply to Ramaแธhan fasts and obligatory fasts which have a limited timeframe.โ€ NOTE 1: If a woman fasts without her husband's permission, what's correct is that her fast is valid, but she is sinful. NOTE 2: If the husband prohibits his wife from fasting obligatory fasts, she must not obey him in this.
