I hope you're not doing this ⤵️ Buy now pay later & installment plans Shaykh Ṣāliḥ as-Suḥaymī regarding Tabby and Tamara payment options “The second issue, this question also came to me at Masjid an-Nabawī, about the ruling on dealing with the companies, Tamara and Tabby (…) The format of its hidden contract; it was revealed to me today that they are not written (upfront), but rather they are hidden. The format is as follows: You buy a merchandise from them in installments. Then, if the time exceeds the installment deadlines, they impose a new amount on you, which they call a penalty. This penalty in reality is nothing but the ribā that was prevalent in the days of ignorance (Jāhiliyyah). Settle (the amount) else pay more. This is the ribā that was present in the pre-Islamic era. Make the payment or pay an increased amount. Meaning, either pay up now, or they raise the price on you. What is the difference? The difference is only in the name by which they call it. They all charge a penalty for this, and many people deal with it in hospitals, for example, in doctors’ clinics and so on. Pay attention, this is a great danger, it is one of the doors of ribā. “The Prophet -may Allāh’s prayers and peace be upon him- cursed the one who takes ribā, the one who pays it, the one who writes it down, and it’s two witnesses.” Narrated by Jābir -may Allāh be pleased with him- in Ṣāḥiḥ Muslim 1598 Be careful, Oh slave of Allāh! What’s strange is that someone gave a fatwā that it’s permissible. However, our senior scholars¹ negated it and clarified that it’s a shade of ribā and warned against it. Another strange thing is that they say that, “this fine that we impose on those who are late in paying is to be spent on the poor and the needy.” I tell them: “Like one who feeds orphans from earnings by losing chastity *** Woe to you, leave off fornication and leave off giving charity.” May Allāh grant success to all in beneficial knowledge and good deeds. And peace and blessings be upon our Prophet Muḥammad -Answered by Shaykh Ṣāliḥ bin Sa’ad as-Suḥaymī حفظه الله, Teacher at Masjid an-Nabawī and Islamic University of Madīnah, Currently authorized to issue fatāwa in Madīnah -Transcribed and translated by Abū Āsiyah Mużaffar -may Allāh forgive him, his parents, family, mashayikh and rest of the Muslims- Translator’s Footnote: Ruling on Tabby and Tamara payment schemes by Shaykh ‘Abdul ‘Azīz ar-Rājihī حفظه الله – https://t.me/shrajhi/2874. Shaykh ʿAbdur-Raḥmān Nāṣir al-Barrāk حفظه الله also mentioned a similar view on 1/3/1444H as can be heard below: https://darulikhlaas.wordpress.com/2023/02/19/ruling-on-buy-now-pay-later-schemes-shaykh-%e1%b9%a3ali%e1%b8%a5-as-su%e1%b8%a5aymi/
