Sheikh Ṣāliḥ Al-Fawzān ḥafiḍhahullāh answered (summarised translation): “Allāh knew that differing will occur between the scholars, this is why He said (translated meaning): ➢ “If you disagree on anything, then refer it to Allāh and His Messenger, if you ˹truly˺ believe in Allāh and the Last Day.” [Sūrah An-Nisā': 59] ➢ “If you disagree in anything, then refer it back to Allāh and to the Messenger.” [Sūrah Ash-Shūrā: 10] ➢ “Surely, We have sent down the Book to you ˹O Prophet˺ in truth to judge between people by means of what Allāh has shown you.” [Sūrah An-Nisā': 105] ➢ “Surely, we have revealed this reminder to you so that you may explain to the people what has been revealed to them.” [Sūrah An-Naḥl: 44] Therefore, a Muslim must refer issues of differing back to the Book of Allāh and the Sunnah of the Messenger ﷺ; whatever is in agreement with the Book and the Sunnah from the statements of the people of knowledge, then he takes that, and whatever differs with the Book and the Sunnah from the statements of the people of knowledge, then he leaves that and takes the statement that is established with evidences. This is the principle in terms of statements & opinions. As for people, then they are of two types: The first type: those who are able to weigh up opinions and analyse their proofs, this type of person must analyse these opinions based on the Book and the Sunnah; so whatever is in agreement with the evidences, he takes it and holds on to it, and whatever opposes the evidences, he leaves it. The second type: the layman or the beginner student of knowledge who doesn’t have the ability and understanding to compare the different opinions, this type of person must ask the people of knowledge just as Allāh said (translated meaning): “Ask the people of knowledge if you do not know.” [Sūrah An-Naḥl: 43] It is not permissible for him to take whatever agrees with his desires on the pretext that this is the verdict given by some of the people of knowledge. Rather it is obligatory upon him, if he has understanding, to adopt the opinion that conforms to the evidences; and if he doesn’t have understanding, he asks those who are more knowledgeable than him. It is not permissible to follow up the concessions of the scholars, i.e. their mistaken opinions and their differences. This is misguidance! Due to this, the scholars have said that the one who follows up the concessions of the scholars will eventually become a heretic. As for the divine concessions, like combining and shortening prayers when travelling, exemption from fasting in Ramaḍhān due to travelling, etc., then these are legislated concessions ordained by Allāh; Muslims should make use of these whenever the need arises, as the Messenger of Allāh ﷺ said: “Allāh loves that you take His concessions just as He hates that you commit sins.” As for concessions in the sense that one follows up the differences of opinions between the scholars and picks and chooses, then this is not permissible, except within the constraints of the Sharī‘ah.”
