BENEFIT 50: A MISCONCEPTION RELATED TO SWEARING BY OTHER THAN ALLĀH It is reported from the Ḥadīth of Ṭalḥah ibn 'Ubaidillāh that the Prophet ﷺ said: ((أَفْلَحَ، وَأَبِيهِ إِنْ صَدَقَ ، أَوْ دَخَلَ الْجَنَّةَ وَأَبِيهِ إِنْ صَدَقَ)) “He will be successful, by his father, if he speaks the truth; or (doubt from one of the narrators) he will enter Paradise, by his father, if he speaks the truth.” 📕[Muslim (11)] MISCONCEPTION: What is apparent from this is the Prophet ﷺ swore by the person's father, because he used the Wāwul Qasam (the و used to bear oath), so is this not proof to show the permissibility of swearing by other than Allāh? RESPONSE: There are two possible responses: THE FIRST: An-Nawawi raḥimahullāh explained: “His saying ﷺ: [He will be successful, by his father] is not an oath, rather it is a phrase which the Arabs are accustomed to using in their speech - without intending the reality of an oath.” 📕[Sharḥ Muslim] THE SECOND: Sheikh Ibn Bāz raḥimahullāh said: ”أما قوله: أفلح وأبيه إن صدق، فإنه قبل النهي، ثم جاء النهي فترك ذلك، وتركه المسلمون، فصار الحلف بالله وحده.“ “As for his saying [He will be successful, by his father], then this occurred before the prohibition (of swearing by other than Allāh), so when the prohibition, came he left that, and the Muslims left that also, so the (permissible) oath was only to swear by Allāh alone.” 📕https://binbaz.org.sa/fatwas/19627/%D9%85%D8%B9%D9%86%D9%89-%D9%82%D9%88%D9%84%D9%87-%EF%B7%BA-%D8%A7%D9%81%D9%84%D8%AD-%D9%88%D8%A7%D8%A8%D9%8A%D9%87-%D8%A7%D9%86-%D8%B5%D8%AF%D9%82
