📝 QUESTION:
السلام عليكم ورحمة الله وبركاته
هناك فائدة ذكرتها إحدى الأخوات،
وهو ما يتعلق بتعريف المحرم، الفائدة تستند إلى قول ابن حجر في الفتح:
((وضابط المحرم عند العلماء من حرم عليه نكاحها على التأبيد بسبب مباح لحرمتها)) اهـ
علقت الأخت بأن الزوج ليس محرما لأنه لا يدخل في التعريف
Assālamu ‘alaikum wa raḥmatullāhi wa barakātuh. There's a benefit relayed by one of the sisters concerning the definition of 'maḥram', and the benefit is based on the statement of ibnḤajar in AlFat-ḥ (where he says):
“the criterion for a 'maḥram' amongst the fuqahā is: someone who is NEVER allowed to marry a woman FOR A VALID REASON or due to her becoming FORBIDDEN (1)” (End quote)
The sister commented that, the husband is not a 'mahram' because he doesn't enter into the definition.

وعليكم السلام ورحمة الله وبركاته المحرم له معنيان من يجوز له الخلوة والنظر والسفر ويحرم عليه النكاح وهذا هو المقصود بالتعريف.
والثاني من في حكمه وهو الزوج إلا أنه مؤقت في الخلوة والسفر وغير ذلك ومتى فارقها بطلاق أو ما في حكمه لم يعد محرما لها.
Wa‘aleikum salām wa raḥmatullāhi wa barakatuh. (The term) 'maḥram' carries two meanings:
1⃣. Someone who a woman can be alone with, look at, travel with, and who is not allowed to marry her - and this is what the definition refers to.
2⃣. One who takes the same ruling as above, and this applies to the husband - ONLY THAT THIS IS TEMPORARY (in his case) i.e. being alone with her, travelling with her, etc., so as soon as he leaves her via divorce or something similar, he is no longer her maḥram.

(1) T.N: This part of the definition excludes the case of 'Al-mulā‘anah' as Ibn Ḥajar mentioned.
[Al-Mulā‘anah is when the husband accuses his wife of adultery. If he cannot provide 4 witnesses then he has to swear oath 4 times that he is truthful in his claim and on the 5th occasion he invokes la‘nah (curse) on the lying party...after this the marriage is annulled and he can never marry her again].
