Chapter One
Summary of the Issue of Ruling by Other than What Allāh Has Revealed
First: A ruler who rules by other than what Allāh has revealed does not fall into major disbelief unless:
1. They explicitly claim the permissibility, denial, rejection, preference, or equality of such judgments.
2. They attribute these judgments to the religion of Allāh (i.e., as a form of substitution).
3. They legislate laws other than what Allāh has revealed and believe in their own right to legislate.
4. They create laws other than what Allāh has revealed and believe they have the authority to legislate alongside Allāh.
There is no disagreement regrading these matters.
Second: Anything beyond the above cases falls under minor disbelief (which does not expel one from the Islam, though it constitutes a major sin).
Third: Those who assert otherwise do not have a correct and explicit evidence to support their claim.
