The Fifth Case: Equality (Al-Musāwāh)

Description: This refers to a person ruling by other than what Allāh has revealed, believing it to be equal to Allāh's judgment. Ruling: There is unanimous agreement that this constitutes major disbelief. The evidence for this is the fact that the one who holds this belief denies the statement of Allāh Almighty: {وَمَنْ أَحْسَنُ مِنَ اللهِ حُكَمًا لِقَوْمٍ يُوقِنُونَ} "And who is better than Allāh in judgment for a people who are certain?" [Sūrah Al-Mā'idah 50], meaning: none is better than Allāh in judgment. Commenting on the fourth nullifier of Islam, Ibn Bāz, may Allāh have mercy on him, said: «ويدخل في القسم الرابع: من اعتقد أن الأنظمة والقوانين التي يسنها الناسُ ؛ أفضل من شريعة الإسلام، أو أنها مساوية لها، أو أنه يجوز التحاكم إليها...» "The fourth category includes those who believe that man-made systems and laws are are better than the Sharī‘ah of Islam, or equal to it, or that it is permissible to refer to them for judgment..."
