The Fourth Case: Preference (At-Tafḍhīl)

Description: This refers to a person ruling by other than what Allāh has revealed, believing that the judgment of other than Allāh is better than Allāh's judgment. Ruling: There is a consensus that this constitutes major disbelief. The evidence for this is two matters: The first: The person who holds this belief is denying the statement of Allāh Almighty: {وَمَنْ أَحْسَنُ مِنَ اللَّهِ حُكْمًا لِقَوْمٍ يُوقِنُونَ} "And who is better than Allāh in judgment for a people who are certain?" [Sūrah Al-Mā'idah 5:50), meaning: none is better than Allāh in judgment. The second: Consensus. Ibn Bāz, may Allāh have mercy on him, said: «من حكم بغير ما أنزل الله یری ذلك أحسن من شرع الله؛ فهو كافر عند جميع المسلمين» "Anyone who rules by other than what Allāh has revealed, believing it to be better than Allāh's law, is considered a disbeliever according to all Muslims" [Al-Fatāwā (4/416)].
