BENEFIT 142: Hiding behind mistaken Fatwas

Sheikh Yūsuf Al-Jazaa’iri hafidahullāh said: "...such university, wherein nakedness prevails, as is known, and then it is said this is an issue of ijtihad. This is not an issue of ijtihād! Nor can anyone argue by saying so-and-so from the scholars allowed it, for they (the upright scholars), by Allah, are more fearful of Allah than to allow this. If they were to see the likes of Al-Kharoobah university (in Algeria), they would warn against it and cry out. If they were to see something like the University of Bani Masous, they would disassociate themselves from such a fatwa and whoever issues such a fatwa. What's more, one cannot argue based on the mistakes of scholars once the evidence is clear. Ibn Abbas (may Allah be pleased with him) said, regarding the matter of Hajj At-Tamattu', "The sky is almost raining stones, I tell you that the Messenger of Allah said something, and you say Abu Bakr and Umar said something else." So if Abu Bakr and Umar's view is rejected due to it going against the words of the Messenger of Allah ﷺ, and Ibn Abbas is stern towards those who follow their views rather than the speech of the Prophet ﷺ, then what about someone who is lower in rank than Abu Bakr As-Siddiq by hundreds of degrees?!
