Dropping The Hadd of Alcohol Due to Bravery in Jihad Ibn Abī Shaybah reported in Al-Muṣannaf with an authentic chain: Abū Muʿāwiyah narrated from ʿAmr ibn Muhājir, from Ibrāhīm ibn Muḥammad ibn Saʿd, from his father, who said: During the Battle of Al-Qādisiyyah, Saʿd (ibn Abī Waqqāṣ) was brought Abū Mihjan, who had drunk alcohol. Saʿd ordered that he be put in chains. When the battle began, Abū Mihjan said to the daughter of Khusafah, the wife of Saʿd: “Release me, and I promise that if Allah saves me, I will return and put my feet back in the chains. And if I am killed, then you will be relieved of me.” She released him when the battle started. He then jumped onto a horse belonging to Saʿd called Al-Balqāʾ, took a spear, and went out to fight. Every time he attacked a part of the enemy, he defeated them. When the enemy was defeated, Abū Mihjan returned and placed his feet back into the chains. The daughter of Khusafah informed Saʿd of what had happened. Saʿd then said: واللَّه لا أضرب اليوم رجلا أبلى اللهَ المسلمين على يدلِه ما أبلاهم “By Allah, today I will not punish a man through whose hands Allah granted the Muslims such victory.” So he released him. Abū Mihjan then said: قد كنت أشربها حيث كان يقام علي الحد فأطهر منها، فأما إذ بهرجتني فلا واللَّه لا أشربها أبدا. “I used to drink it knowing the punishment would be carried out on me and I would be purified by way of it. But now that you have pardoned me, by Allah, I will never drink it again.” How was he excused for a hadd from the hudood of Allah? Ibn Al-Qayyim mentioned in Iʿlām Al-Muwaqqiʿīn: ((فإنه بتسليمه نفسه ووضع رجله في القيد اختيارا قد استحق أن يوهب له حده كما قال النبي -صلى الله عليه وسلم- للرجل الذي قال له: "يا رسول الله أصبت حدا فأقمه علي، فقال: هل صليت معنا هذه الصلاة؟ قال: نعم، قال: اذهب فإن الله قد غفر لك حدك)) “By surrendering himself and willingly placing his feet back in the chains, he deserved that the punishment be waived for him—just as the Prophet ﷺ said to a man who told him: ‘O Messenger of Allah, I have committed an offense deserving a punishment, so carry it out on me.’ The Prophet ﷺ said: ‘Did you pray with us this prayer?’ He said: ‘Yes.’ The Prophet ﷺ said: ‘Go, for Allah has forgiven your offense.’” ____ The series thus far, may Allāh facilitate its completion ⤵️ https://t.me/madrasatuna/5582
