Fiqh Al-Jināyāt (Islamic criminal law) represents the final quarter of Fiqh studies and is a major branch that deals with justice, rights, and accountability. Studying it serves several crucial purposes: 1⃣. Comprehending the Sharīʿah in its entirety – Islam is not limited to acts of worship like prayer and fasting; it also provides guidance on governance, crime, and the protection of life, property, and dignity. Understanding criminal law is essential for grasping the comprehensive nature of the Sharīʿah. 2⃣. Filling gaps in knowledge – The Qur’ān and Sunnah contain numerous verses and teachings related to criminal justice. Ignoring this branch of Fiqh leaves a significant gap in our understanding of Islamic law. 3⃣. Preserving the Deen – Learning every part of the religion, regardless of its immediate relevance, contributes to its preservation. 4⃣. Preparing for future relevance – What may seem less applicable today could become highly relevant tomorrow, especially in discussions of governance, law reform, or the implementation of Sharīʿah. Even rulings not currently applied teach students critical skills in legal reasoning, justice, and the methodology scholars use to derive rulings. Like a medical student studying rare diseases, a student of Fiqh studies all branches to understand the full framework Islam provides for justice. 5⃣. Comparative insights – Understanding how Allāh’s divine laws address crime and punishment exposes the flaws in man-made legal systems, highlighting their ethical, philosophical, and practical weaknesses. 6⃣. Clarifying misconceptions – Islamic criminal law is often misunderstood. Studying it ensures Muslims avoid extremes: Ahl Al-Ifrāṭ (the extremists) who misuse Sharīʿah to justify oppression and violence. Ahl At-Tafrīṭ (the negligent) who ignore or downplay Sharīʿah’s guidance. A solid understanding of Islamic criminal law also equips Muslims to respond to accusations that Allāh’s laws are outdated or harsh, demonstrating their wisdom and justice.
