A brother reached out to a Salafi Da'ee in France to confirm if this question is true, and the brother said:
نعم صحيح هذا، هو قرار ملزم لكل مسجد رسمي في فرنسا، وكذلك مسجدنا، ولكن مسجدنا جمعيته فارغة إنما هي عبارة عن اسم فقط فلا رأس لها ولا ذيل كما يقال.
"Yes, that is correct. This is a mandatory decision for every officially recognised masjid in France, including ours. However, our masjid's charity organisation exists in name only—it has no head or a tail, as the saying goes."
Reflections:
1. In cases of ضرورة (necessity), two key conditions must be observed to avoid sin, as Allāh ﷻ states:
﴿فَمَنِ ٱضۡطُرَّ غَیۡرَ بَاغࣲ وَلَا عَادࣲ فَلَاۤ إِثۡمَ عَلَیۡهِ﴾
"Whoever is forced [by necessity],
1) neither desiring [it],
2) nor transgressing [its limits],
there is no sin upon him."
[Sūrah al-Baqarah: 173]
Likewise, a Muslim must still dislike the unlawful act, even when compelled to engage in it. Scholars emphasise that one should only partake in a prohibited act under necessity with reluctance and sincere aversion, always remembering that without necessity, they would never engage in it.
Based on the brother’s words, it appears that they are adhering to these conditions—may Allāh reward them.
2. On the other hand, some operate charity organisations under the pretense of ضرورة (necessity), when in reality, such a situation does not exist in their country as it does in places like France.
Despite this, they fail to observe the above conditions and instead run their organisation like a full-fledged charity organisation by:
-> Soliciting funds through various means (sports tournaments, food bazaars, etc.)
-> Travelling from town to town
-> Publicising fundraising efforts through pictures, videos, and even documentaries
-> Defending their approach with weak arguments
-> Allowing mainstream charity organisations to raise funds in their masjid
One of their primary justifications for soliciting funds is basing this on need/necessity. However, one must ask:
-> If it is truly necessary why wait until Ramaḍān to launch the fundraising campaign?
-> Is it necessary to raise funds to cover an entire year’s rent and to also establish a nursery, nikāḥ services, tuition programmes, etc.?
3. Worse still, some of those affiliated with this organisation defend the likes of Muhammad Al-Imam, Suhaib Hasan, ’Ali Al-Halabi, etc., even going as far as quoting the latter's definition of tamyee‘ in a "manhaj" dawrah—the very issue he was accused of (may Allāh forgive him).
Our esteemed Sheikh Yahya (may Allāh preserve him) stated:
علي الحلبي مميع! صحيح دعوته دعوة تمييع بصراحة ومحاجّ عن الذين هم ضد أهل السنة! محامي عنهم... يعني الكلام كله والملازم كلها ما طنت في أذنه!! كل الكلام في أبي الحسن ما طن في أذنه! وما كفاه زاجرا مما عليه أبو الحسن لأن الشبكة واحدة ! هذه حقيقة!!
"Ali Al-Halabi is a Mumayyi‘! Indeed, his Da'wah is one of Tamyee'. He openly defends those who oppose Ahlus-Sunnah—he is their advocate!... As for Abul-Hasan, despite all the warnings and refutations against him, none of it ever seemed to register with Al-Halabi, nor did it serve as a deterrent; because they are part of the same network. This is the reality!"
