Ungenuine Case of ضرورة

It is INCORRECT to apply the principle: ما لا يتم الواجب إلا به فهو واجب "What is necessary to fulfill an obligation becomes obligatory itself" to argue that establishing a charity organisation solely for the purpose of da‘wah constitutes a necessity (ضرورة). This is because the obligation of da'wah can still be fulfilled through other means. Thus, applying the principle (إلا به) in this context is incorrect, as the obligation can still be fulfilled through alternative means (يتم الواجب بغيره). _ In the Name of Allāh, the Most Gracious, the Most Merciful All praise is due to Allāh, the Lord of all worlds. May peace and blessings be upon our Prophet Muhammad, his family, and all his companions. On the evening of Monday, 15 Sha‘bān 1432 AH, I had the honor of visiting our esteemed Sheikh and father, Rabī‘ ibn Hādī ‘Umayr Al-Madkhalī (may Allāh preserve him). Among the questions I presented to him was the following: I asked about the ruling on establishing charity organisations in Tunisia to facilitate the invitation of scholars and the organisation of lessons and educational programmes. He (may Allāh preserve him) responded: "I believe that charity organisations cause division among the Salafis and are a source of Hizbiyyah. My advice to them is to avoid such organisations, to seek knowledge in the masājid, and to refrain from establishing these organisations. I do not see it permissible for them to join such organisations. If they are unable to conduct lessons in masājid, then they should pursue knowledge in their homes." This was his response (may Allāh preserve him). I then asked him about establishing academic centres for the same purpose. He replied: "They should hold lessons in the masājid—may Allāh bless you. They must conduct their lessons in the masājid." This was his response (may Allāh preserve him). We ask Allāh, the Almighty, to guide our brothers in Tunisia toward wisdom and righteousness, to grant them success in adhering to the guidance of the scholars, for therein lies goodness, light, guidance, and sound judgment. What do you advise us to do? May Allāh reward you with goodness. He (may Allāh preserve him) responded: Fear Allāh as much as you are able: "Allāh does not burden a soul beyond its capacity" [Al-Baqarah: 286]. Undoubtedly, a person can still engage in da‘wah. One can give Da'wah in a car—no one can prevent him from speaking in his own vehicle. Likewise, he can give Da'wah in his home. Even if only his family knows that he is a caller to Allah, he is still considered among those engaged in da‘wah and may attain great reward. He can also reach out to those who visit him or contact him. Allāh says: "So fear Allāh as much as you are able" [At-Taghābun: 16]. If he is able to write and author beneficial works, he should do so and spread knowledge, guiding people to places where they can seek beneficial knowledge. If he is granted an official permit to preach, he should take it.
