A Genuine Case of ضرورة

The questioner asks: In our state...where is your state, my brother? In Nigeria...the government does not permit the establishment of Jumu‘ah prayers unless we register under one of the approved charity organisations. These charity organisations are either affiliated with a party similar in structure to the Ikhwa Al-Muslimoon or are linked to Sufi orders, specifically the Tijaniyyah. What is your advice and guidance on this matter?" Sheikh Muḥammad Ba Jammāl responds: Registering under such organisations is problematic. However, if Jumu‘ah prayers cannot be established in your area and the government only grants permission under this condition, then this–and Allah knows best–falls under the principle of necessity (ضرورة), as fulfilling an obligation sometimes depends on taking necessary measures. On the other hand, if there are already existing Jumu‘ah congregations led by Hizbi groups or innovators, then there is no need to join or affiliate with these organisations. And Allāh knows best.
