BENEFIT 354: What is the ruling on charity organisations if they are free from evils–since this is a point frequently raised by some, who claim that charity org

Sheikh Yūsuf Al-Jazaa’iri hafidahullāh said: Our response is that this claim is not accepted. The answer to this and similar objections is that the assumption that charity organisations are entirely free from evils is purely hypothetical, a conceptual construct with no actual existence in reality! 📌 Furthermore, it can be said to them that there is no charity organisation that does not contain some degree of these evils, whether in greater or lesser measure. The mere reduction of evil does not negate the prohibition,📌 for the condition for permissible means of propagation in religious matters is that they must align with the methodology of the Prophet in Da'wah and be sanctioned by the Shari'ah. Any means employed for Da'wah that is not explicitly sanctioned, and contains elements of wrongdoing—even if minor—must be prohibited. The evidence for this is found in the words of Allāh: "Indeed, We have sent you as a witness, a bearer of glad tidings, and a warner, and as one who invites to Allāh by His permission." [33:45-46] Thus, the means of Da'wah—i.e. educational and instructional methods—are tawqeefiyyah; they must be endorsed by the Shari'ah and free from any prohibited elements to fall under His saying "by His permission." If they do not meet these conditions, they must be rejected, even if they appear to achieve a beneficial objective(1), as will be further explained. Imām Muqbil Al-Wādi‘ee (may Allāh have mercy on him) was asked about a charity organisation that, according to its proponents, was entirely free from prohibited elements, sins, or compromises. He ruled against it, prohibiting its establishment. This ruling is documented in the treatise "As-Sihām Al-Wādi‘iyyah fi Nuhūr Aqṭāb Al-Jama‘āt Al-Ḥizbiyyah" by Sheikh Abu Abdissalām Ar-Raymi (may Allāh preserve him), where the explicit text of the ruling can be found. Imām Al-Wadi‘ee, who was among the most knowledgeable scholars regarding charity organisations and their harms—having personally witnessed how they led some of his students astray—prohibited the establishment of such organisations. His ruling was based on the fact that these organisations are an innovation in religious propagation and serve as a ذرية gateway to the numerous harms associated with them. Even if the only objection were that such organisations are an innovation in the field of religious propagation and have been adopted from the enemies of Islam, that alone would suffice as grounds for their prohibition. Additionally, the mere fact that these organisations deposit funds in banks would be sufficient to invalidate them, as was mentioned by Imām Al-Albāni (may Allāh have mercy on him). Furthermore, it is a well-established principle in the Shari'ah that rulings are based on the underlying realities of things, not merely on their names or outward appearances. No matter what names these organisations adopt or how attractive they may seem, what truly matters is their essence and the prohibited elements they contain—elements that, as previously explained, no charity organisation is free from. ___ (1) The ends do not justify the means.
